Oh Crumbs!

All Products made by Oh Crumbs! are subject to the following terms and conditions, which are intended to eliminate potential grey areas and help both me the baker and you the Customer to enjoy a smooth, stress-free transaction.

Please read these Terms and Conditions carefully before paying for your order and contact me with any questions because once you have paid it is assumed that you have read and agreed to them.

1. Ingredients

• 1.1 All Products, fillings, icing and decor may contain, or come into contact with, any of the fourteen (14) UK recognised allergen categories, and other potential allergens.
• 1.2 It is the responsibility of the Customer to inform me of any allergy issues before confirming their booking and to inform their guests of all allergy information related to the Product. Accordingly I will not be held liable for any allergic reaction resulting from consumption of any Product baked by me.
• 1.3 All Products are made to be eaten on the day of collection or delivery.
• 1.4 It is the responsibility of the Customer to remove any/all non-edible elements of the Product prior to consumption.

2. Orders

• 2.1 At least fourteen (14) days' notice is preferred for all orders. Where possible I will try to accommodate short-notice orders but this cannot be guaranteed.
• 2.2 Any Products ordered from a photo, picture or image can only be reproduced by me as my interpretation of that Product. I cannot guarantee my Product will be an exact reproduction of the Product in the photo, picture or image, although every effort will be made to replicate it as accurately as possible.

3. Cake Contract

• 3.1 All orders will be followed up with a Cake Contract detailing the order from the Customer. Please read your Cake Contract carefully to ensure all the information in it is correct. Before paying a non-refundable deposit (NRD, see section 4) the Customer must confirm in writing that the Cake Contract is correct. (FaceBook messenger is accepted.) I am not liable for any errors missed by the Customer.
• 3.2 The Cake Contract will include the agreed collection date and time.

4. Deposits

Orders less than £30 may pay in full in advance (BACS) or cash upon collection. Please check at the time of booking which option is available for your order.

• 4.1 Orders of £30 or over require a 50% non-refundable deposit (NRD) to secure your date. This must be paid by BACS transfer no later than ten (10) days prior to the agreed date of collection. The outstanding balance is due on collection, either by BACS transfer or in cash.
• 4.1.1 For short-notice orders requiring collection in under ten (10) days, the NRD is due immediately and in full upon booking.
• 4.2 BACS payments: Use your first initial and full surname for the reference so your payment can be identified. For example: S.SMITH
• 4.2.1 If someone else is paying on your behalf, ensure they use YOUR first initial and full surname as the payment reference.
• 4.3 Where I have created what is stated in the Cake Contract but the Customer does not accept the finished Product, the NRD WILL NOT be refunded. The Customer can choose to pay the balance and take the Product(s), or leave them at no extra cost.

5. Unforeseen Circumstances

• 5.1 If I have to cancel the booking due to unforeseen circumstances that affect my ability to produce the ordered Product, the NRD will be refunded within ten (10) days of notification to the Customer.
• 5.2 In this event, such Goodwill gestures are not guaranteed nor can they be demanded. They may be possible, at my exclusive discretion.
• 5.2.1 If Goodwill is decided upon then the arrangement of this will be communicated in writing.
• 5.2.2 Goodwill gestures may only be redeemed by the Customer named on the original Cake Contract.

6. Final Balance Payments

• 6.1 The outstanding balance is due on the collection date and before the Product leaves my premises.
• 6.2 Final payment is preferred in cash and correct change is appreciated as I may not have the exact change on my premises.
• 6.3 If the final payment is made by BACS or card, the money must be demonstrably in my account BEFORE the Product leaves the premises.

7. Collection Process

• 7.1 Orders for Wedding cakes and larger (two-tier) celebration cakes can be delivered by prior arrangement. Delivery is direct to the function venue where the Product will be staged (such as a club, hotel, hall or stately home.) I do not deliver to private addresses. A delivery charge will apply dependent on mileage.
• 7.2 All other orders are collection only from Duns, TD11 3ER. Full address will be supplied at the point of booking.
• 7.3 Please note the premises are private property and cannot be entered.
• 7.4 The date and time of collection is stated in the Cake Contract.
• 7.5 It is the responsibility of the Customer to check the condition of the Product before leaving the premises. Once the Product has left our hands the Customer is responsible for ensuring the Product arrives at their destination safely and is stored according to my instructions to achieve the best results for taste and quality.
• 7.6 If a third party will be collecting the Product on the Customer's behalf, the Customer must inform me in writing that this is the arrangement. The third party will act on behalf of the paying Customer and will be required to follow point 7.5 as above.
• 7.7 The Customer or their assigned third party is liable for any damage, accident or mishap that may occur once the Product is released by me. I am not liable for any damage that may occur thereafter.

8. Postponement or Changes

• 8.1 If for any reason the event for which the Product has been booked has to be postponed, or changes to the order itself are required, please contact me immediately.
• 8.2 The new collection date proposed will be subject to my availability.
• 8.3 Where possible I will accommodate change from the original Customer as named on the Cake Contract, and a revised Cake Contract will be agreed prior to progressing.
• 8.4 If the postponement or changes incur an additional expense to me, this is to be covered by the Customer and is payable immediately. This additional cost will become part of the NRD. For example:
  50% NRD of £30 + Final payment outstanding of £30 = £60 original total
  Changes incur an additional £7. NRD + Changes = £37.
  Updated NRD is now £37, payment outstanding at collection is unchanged at £30 so total payment for the Product is now £67.

9. Cancellations and Refunds

• 9.1 If the Customer cancels the order and the full balance has been paid in advance, the refund policy is as follows:
• 9.1.1 If the cancellation is up to thirty (30) days in advance of your collection date you will receive a refund, less your 50% NRD (or updated NRD for any changes that incurred cost) plus the cost of any supplies already purchased by me, for your Product.
• 9.1.2 If the cancellation is less than seven (7) days before your collection date, absolutely NO refunds will be given.
• 9.2 Refunds will be paid within ten (10) days of notification of cancellation.

10. Publications

• 10.1 I reserve the right to use any image of a Product I have created, for use by me for publication on any social media at a later date.
